01 Agreement to terms
These Terms of Use ("Terms") govern your access to and use of www.flamingolifestyles.com, our customer portal, and the products and services we provide. By using the site, creating an account, placing an order, or engaging us for a project, you agree to these Terms. If you do not agree, please do not use the site or services.
Where you sign a separate work order, proposal or invoice with us, the terms in that document supplement and, where they conflict, prevail over these Terms for that specific engagement.
02 Who we are
Flamingo Lifestyles ("we", "us", "our") is a Bengaluru-based studio offering interior design, furnishing, construction, project management, custom furniture, after-care, and the signature furniture collection. We are registered in India under GSTIN 29CLQPD8025F1ZW, with our studio at Sy No. 87, Virgonagar Post, Bidarahalli Hobli, Cheemasandra, Bengaluru 560049.
03 Eligibility
You must be 18 years or older and competent to enter into a contract under Indian law to use the site, place an order, or engage us. By using the site you represent that you meet these requirements. If you are using the site on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.
04 Your account
To use the customer portal, place orders or track projects, you may need to create an account. You agree to:
- Provide accurate, current and complete information about yourself.
- Verify your mobile number using the one-time password (OTP) we send.
- Keep your password confidential and not share your account.
- Notify us at security@flamingolifestyles.in immediately if you suspect unauthorised access.
- Use the account only for lawful purposes and in compliance with these Terms.
You are responsible for all activity that takes place under your account. We may suspend or terminate accounts that breach these Terms or applicable law.
05 Services and the signature collection
a. Studio services
Interior design, furnishing, construction, project management, custom furniture and after-care are quoted on a per-project basis. Each engagement is governed by a written work order or proposal that sets out the scope, deliverables, schedule, payment milestones, change-order process and any project-specific terms. The site itself does not constitute a binding offer; an estimate becomes a contract only on signed acceptance and receipt of the agreed advance.
b. Signature collection
Selected pieces from our furniture collections — including Kensington, Alcazar, Brennen, Westminster, Richard, President, Metamorph, Stargate, Oligarch and Matlin — are available for direct purchase from the site and delivered to your residence or office. Each listing shows the price, dimensions, materials, lead time and stock status. Listings are an "invitation to treat" and we reserve the right to accept or decline any order.
c. Limited and made-to-order pieces
Many pieces are made to order, with the maker building them after the order is placed. Some pieces are released as limited editions. Lead times, customisation options and order minimums are stated on each listing.
d. Hand-finished variation
Solid wood, veneer, leather, fabric, brass and marble are natural materials. Variations in grain, colour, weave and finish are inherent to handcrafted furniture and are not defects.
06 Pricing, taxes and payment
- All prices are in Indian Rupees (INR) unless stated otherwise. Where we publish prices in another currency for convenience, the binding amount is the INR figure on the invoice.
- GST is applied as required, at the rate prevailing on the date of the invoice. HSN codes (typically 9403 for furniture) appear on every invoice.
- Online payments are processed via Razorpay (cards, UPI, net-banking, EMI, wallets) or by NEFT / RTGS to the studio's bank account where the order or invoice indicates so.
- For service projects, payments follow milestone schedules in the work order. A typical structure is: advance on signing, design sign-off, mid-build, pre-handover, retention.
- For made-to-order or custom pieces from the signature collection, our standard practice is 75% advance with the order and 25% before despatch, unless the listing states otherwise.
- We may revise prices on the site at any time. The price you see at checkout is the price that applies to your order, subject to verification.
- If a price is shown incorrectly due to an error and the order has not yet shipped, we will notify you and either honour the published price, refund the order or allow you to repurchase at the corrected price — at your choice.
07 Orders, lead times and delivery
- Stock pieces typically ship within 7–14 working days from order confirmation.
- Made-to-order pieces typically ship 4–10 weeks from order confirmation, depending on the piece.
- Custom commissions ship per the timeline in the signed work order.
- We deliver across India. International deliveries are quoted on a case-by-case basis.
- Transport, packing, white-glove delivery and on-site installation are billed at cost where applicable, separately on the invoice.
- Risk of loss passes to you on delivery. Please inspect the item(s) before signing the delivery note. Photograph any concerns and inform us within 48 hours.
- We are not responsible for delays caused by access issues at the delivery address (lifts, narrow stairwells, security restrictions). Where we are asked to make multiple delivery attempts due to client-side issues, additional charges may apply.
08 Cancellations and changes
The full policy is in Refund & Cancellation. In summary:
- Stock orders — free cancellation before despatch; 7-day return window after delivery if the item is unused, in original packaging and not personalised.
- Made-to-order pieces — free cancellation within 24 hours of order; not cancellable once production has started.
- Custom commissions — not cancellable once design is signed off and materials are procured.
- Service projects — governed by the specific work order; design retainers are non-refundable.
- Change requests on a service project are documented as a change order, with cost and timeline impact agreed before work starts.
09 Customer-uploaded content
When you upload plans, drawings, 3D renders, references, photographs or any other content to the estimate form, the customer portal, or share it with us via WhatsApp or email, you grant Flamingo Lifestyles a non-exclusive, royalty-free, worldwide licence to store, copy and use that content only for the purpose of scoping, executing and supporting your project.
You represent that you have the right to share the content and that doing so does not infringe any third-party rights. We will not publish, display publicly or share your content with anyone outside the project team without your prior written consent. Project photography we commission once a project is complete is governed by the specific terms in the work order, and we will always ask before publishing.
10 Intellectual property
All content on the site — including text, photography, logos, designs, drawings, 3D renders, models, software, and the look-and-feel of the site — is owned by Flamingo Lifestyles or our licensors and is protected by Indian and international copyright, trademark and other laws. You may view and print site content for personal, non-commercial reference only.
Designs, drawings and renders that we create as part of a service project remain ours unless explicitly assigned in writing in the work order. You have a perpetual, royalty-free licence to use the deliverables in the property they were created for.
"Flamingo Lifestyles" and the flamingo mark are our trademarks. You may not use them in any way that creates confusion about source, sponsorship or endorsement.
11 Acceptable use
You agree not to:
- Use the site or services for any unlawful, fraudulent or harmful purpose.
- Attempt to gain unauthorised access to any account, system, network or data.
- Reverse-engineer, scrape, replicate or otherwise extract the site or platform.
- Upload viruses, malware, ransomware or any code intended to harm us, our customers or our infrastructure.
- Use our intellectual property, brand or content without prior written consent.
- Misrepresent your identity, impersonate any person, or submit false information.
- Resell our products, services or designs without prior written consent.
- Use any automated means (bots, crawlers, scripts) to access the site beyond standard search-engine indexing.
- Interfere with the orderly operation of the site or the experience of other users.
Breach of this section may result in suspension or termination of your account, refusal to fulfil orders, and where appropriate, legal action and reporting to authorities.
12 Warranty and after-care
- Signature collection — each piece carries a 12-month limited warranty against manufacturing defects, starting from the date of delivery. The warranty card and full terms are issued with the invoice and are also available in the customer portal.
- Custom commissions — covered under the specific terms of the work order; typically a 6 to 12 month workmanship warranty.
- Service projects — a 30-day post-handover snag period as standard. Optional Annual Maintenance Contracts (AMC) are available for ongoing care.
- Not covered — wear and tear, misuse, damage caused by transport not arranged by us, modifications by third parties, exposure to extreme heat or moisture, natural variations in material, and incidents covered by your home insurance.
Photographs and the original invoice are required to make a warranty claim. We may inspect the item or site before deciding on the appropriate remedy (repair, replacement or refund).
13 Limitation of liability
To the maximum extent permitted by law:
- Our aggregate liability for any claim arising out of or in connection with the site, the signature collection or our services is limited to the total amount you paid to us in the 12 months immediately before the event giving rise to the claim.
- We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages — including lost profits, lost data, lost goodwill, or business interruption — even if we were advised of the possibility.
- We are not liable for delays or failures caused by force majeure (Section 14).
- Nothing in these Terms excludes liability that cannot lawfully be excluded under Indian law, including liability for fraud, gross negligence, or for death or personal injury caused by our negligence.
14 Force majeure
We are not in breach of these Terms or any work order if our performance is delayed or prevented by events beyond our reasonable control. These include — without limitation — natural disasters, fires, floods, earthquakes, epidemics, pandemics, government action or shutdowns, strikes or industrial action, riots, war, terrorism, internet or telecommunication outages, supplier or carrier failures, and statutory restrictions on construction or movement of goods.
Where a force-majeure event lasts more than 60 consecutive days, either party may terminate the affected engagement on written notice. In that case, we will refund any amounts paid for work not yet performed and materials not yet procured.
15 Third-party links and integrations
The site links to third-party websites — Google Maps, social media platforms, supplier and partner sites. We are not responsible for the content, accuracy, security or privacy practices of those sites. Visiting a third-party link is at your own discretion.
Our integrations with Razorpay, Firebase, WhatsApp Business and similar services are also governed by those providers' own terms. Where you use those features, you agree to comply with their terms in addition to ours.
16 Governing law and disputes
These Terms and any dispute arising out of or in connection with them are governed by the laws of India. The parties agree to first attempt to resolve any dispute through good-faith negotiation for a minimum period of 30 days. Failing that, the dispute shall be subject to the exclusive jurisdiction of the competent courts in Bengaluru, Karnataka.
This clause does not prevent us or you from seeking urgent injunctive relief from any court of competent jurisdiction.
17 Changes to these Terms
We may revise these Terms from time to time. The "Effective" date at the top of this page indicates the latest revision. Material changes will be communicated by email and/or with a banner on the site. Continuing to use the site or services after a change indicates your acceptance of the revised Terms.
18 Severability and entire agreement
If any provision of these Terms is held unenforceable by a court or other tribunal of competent jurisdiction, the remaining provisions remain in full force. These Terms — together with any work order, invoice, warranty card or supplementary policy referenced here — represent the entire agreement between you and Flamingo Lifestyles in relation to the subject matter and supersede all prior understandings.
